TERMS & CONDITIONS

ARTICLE 1: FIELDS OF APPLICATION AND PURPOSE

These General Conditions of Sale are concluded between Estelle Paulet, under the commercial name LAMAES, at 7 rue des quatrefages, 30000 Nîmes, registered with the RCS of Nîmes under the number  851 554 519,  and anyone who has made a purchase on the site www.lamaes-beaute.com, (hereinafter referred to as "Customer"). Any order placed on the site  www.lamaes-beaute.com  (hereinafter referred to as "Site") entails  automatically the acceptance of these conditions which the Customer acknowledges having read prior to his order.

Before placing his order, the Customer declares to be legally capable  to commit to these General Terms and Conditions of Sale.

LAMAES  reserves the right to modify at any time  these General Terms and Conditions of Sale, which the Customer should consult regularly.

SECTION 2  : PRODUCTS

LAMAES undertakes to present and describe on the Site the products marketed in the most precise manner.  and faithful so that the Customer has all the necessary information before taking an order.

The products are offered within the limits of the stocks available at the time of the act of purchase by the Customer. A product that is unavailable will be indicated as such. LAMAES undertakes to make every effort to ensure the availability of marketed products.

SECTION 3  : PRICE

The sale prices indicated on the entire Site are inclusive of all taxes (TTC),  are indicated in euros and correspond to those displayed on the Site at the time of the Customer's order.  LAMAES reserves the right to modify its prices at any time and without notice, without affecting orders already accepted by LAMAES before this modification.

Prices include Value Added Tax (VAT) applicable on the day of the order.

The goods remain the full property of LAMAES until receipt of the total amount due paid by the Customer.

The Customer is informed that the delivery costs will be invoiced in addition to the price of the products and will be indicated in the order summary, before registration.  of the order.

 

SECTION 4  : ORDERED

Any order placed on the Site entails acceptance of the General Conditions of Sale.

Before​ to validate his order definitively, the Customer can  at any time  check and modify your basket by clicking on the "basket" icon.  The order is validated once the entire  payment has been received  by LAMAES.

LAMAES undertakes to fulfill orders within the limits of available stocks.

LAMAES recommends that the Customer keep the information contained in the order confirmation. For its part, LAMAES archives the purchase orders and invoices that can be produced as evidence in the event of a conflict with the Customer.

In accordance with the provisions of  article L.122-1 of the Consumer Code,  LAMAES is entitled to refuse any abnormal order, placed in bad faith or resulting from unpaid or fraudulent use of a bank card.

SECTION 5  : PAYMENT

Orders are payable by credit card (CB, VISA, Mastercard) or by PayPal.

When paying by credit card, the  Customer's payment may be submitted  to a 3D Secure verification. After providing their bank details, a 3D Secure window from their bank will open and  an SMS code will be sent to him. To validate his order, the Customer should enter this code in the space provided.

 

As part of procedures  of control, LAMAES may be required to ask its Customers for all the documents necessary for the validation of their  ordered. LAMAES agrees that these documents will not be used for purposes other than these.

SECURE PAYMENT AND PROTECTION OF BANKING TRANSACTIONS

Transactions are carried out on the Site in a secure manner. LAMAES entrusts the security of its transactions to its provider Stripe.

Banking data only circulates on the Internet in encrypted form, i.e. they are coded in such a way as to make them completely unreadable and  are in no way retained by LAMAES.

ARTICLE 7: RECEPTION

Every order is delivered  to the address indicated by the Customer when placing the order. The Customer must ensure that his personal data provided during the validation of his order are complete and accurate. In case of parcel return  to LAMAES linked to an incorrect or incomplete delivery address, LAMAES will contact the Customer.  Return shipping costs will be borne by  client.  LAMAES cannot be held responsible for the impossibility of delivering the order.
 

DAMAGED PACKAGE

Upon receipt of the order, the Customer  is required to check the condition or content of his package.

Delivery without signature: if the Customer finds that his package is damaged or  damaged, he may, provided the package has not been opened, refuse the package by returning it to a post office within 2 days of its distribution.

Delivery with signature: yes  the Customer notices that his package is damaged or  damaged, he can refuse the package which will be returned directly to LAMAES or accept it while notifying the carrier of the deterioration of the packaging.

 

The Customer must indicate any anomaly on the delivery note,  in handwritten form and accompanied by his signature. The Customer must report the anomaly directly to the carrier and must  also report this anomaly to LAMAES at the email address: contact@lamaes.fr within a mandatory period of 3 days, attaching any photos and proof of complaint addressed  of the carrier.  After this period of 3 days, LAMAES cannot turn against the carrier and thus obtain compensation neither for LAMAES nor for the Customer.

The Customer can consult the procedures for returning damaged parcels directly on the La Poste website.

SECTION 8  : RETURN AND RIGHT OF WITHDRAWAL

In accordance with article L.121-28 of the Consumer Code, the right of withdrawal of 14 days cannot be exercised for  contracts for the supply of goods which have been unsealed by the Customer after delivery and which cannot be returned for reasons of hygiene or health protection (care products, make-up, etc.).

In this sense, LAMAES does not accept the  return of products after delivery for reasons of hygiene and health protection.

SECTION 9  : PROMOTIONAL CODES

Promotional codes can only be used once per Customer account and cannot be combined with each other.

 

 

SECTION 10  : PRIVACY RESPECT

All personal data communicated by the Customer on the Site  are exclusively intended  the processing and delivery of orders as well as the customization of the LAMAES offer in terms of samples and communication. These data remain strictly confidential.

 

The Customer can subscribe to the LAMAES newsletter and thus choose to be regularly informed of the offers offered. He has, at any time, the possibility of unsubscribing by clicking on the link provided for this purpose on each of the newsletters.

In accordance with the Data Protection Act of January 6, 1978, the Customer  has  a right of access, rectification  and opposition to personal data concerning him. For this, the Customer must contact  LAMAES at contact@lamaes.fr.

SECTION 11  : COOKIES

By browsing the LAMAES Site,  information relating to your browsing may be recorded in "  Cookies  » installed on your device or browser. These cookies make it easier for the same person to use the Site later and to take over the preferences chosen by a user during his visit.  It is possible for you to limit the use of cookies by configuring your browser, this nevertheless limiting the use of certain services that we offer on our site. You also have the option of deleting cookies manually.

SECTION 12  : INTELLECTUAL PROPERTY

The content of the Site is the exclusive property of Estelle Paulet, under the trade name LAMAES, and is protected by intellectual property law. As such, any total or partial reproduction of this content is strictly prohibited and is likely to constitute an act of infringement.

SECTION 13  : RESPONSIBILITY

LAMAES cannot be held responsible for any damage resulting from improper use of the products by the Customer. It is reminded that the Customer carries out under his sole responsibility the purchase  of its cosmetic products taking into account the characteristics of the products and the specificities and possible contraindications which are personal to it.

LAMAES cannot be held liable for any inconvenience or damage inherent to the Internet network, in particular any disruption of the connection or any intrusion of a computer virus.

 

LAMAES cannot be held  responsible for the final quality of the products distributed, nor for the undesirable effects that they could cause. The manufacturers of the products remain solely responsible for this.

 

LAMAES cannot be held  responsible for the non-performance of its obligations  in the event of force majeure, by a third party or by the Client. The responsibility of LAMAES could in no case be engaged in the event of non-performance or poor performance of the contractual obligations attributable to the Customer, in particular when entering his order.

The liability of LAMAES is limited  the amount of the Customer's order.

SECTION 14  : GUARANTEES

The products marketed on the Site are subject to the legal guarantee of conformity and the guarantee against hidden defects.

The legal guarantee of conformity set out in articles L.217-4 and following of the Consumer Code is a guarantee against all defects of conformity already existing on the date of delivery. The Customer has a period of 2 (two) years from receipt of the product to implement this guarantee. The Customer will have the choice between the repair and the replacement of the non-compliant product, subject to the cost conditions.

The warranty against hidden defects set out in articles 1641 and following of the Civil Code is a legal warranty  against a defect  hidden  making the product  unusable or greatly reducing its use. The Customer has a period of 2 (two) years from the discovery of the defect to implement this guarantee. The Customer will have the choice between a total refund  or part of the product.

SECTION 15  : DISPUTES AND  COMPLAINTS

LAMAES makes every effort to give complete satisfaction to the Customer.

For any dispute LAMAES and the Customer undertake to meet as soon as possible and to find an amicable solution to their dispute.  In accordance with the provisions of the Consumer Code concerning the amicable settlement of disputes, the Customer is informed that he may have recourse to a mediator. The Customer may present his complaint on the platform put online by the European Commission, which will transfer the complaint to the competent national mediators.

SECTION 16  : APPLICABLE RIGHT

These General Terms and Conditions of Sale and the resulting operations are governed by and subject to  to French law.
